The Cross-Appeal filed by the Independent National Electoral Commission (INEC), challenging the decision of the National and State House of Assembly Tribunal that sat in Jos, delivered on the 10th of September, 2019, in petition No. EPT/PL/NA/HR/10/2019, filed by Hon. Timothy Golu and the Peoples Democratic Party (PDP) with respect to the election for Member House of Representatives for Pankshin/Kanka/Kanam Federal Constituency of Plateau State, has been struck out at the instance of the Appellant by the Court of Appeal, Jos Division.

Before the Court’s decision to strike out the Appeal, J. J. Usman (Esq), the Appellants Counsel, had applied for the withdrawal of the Appeal, owing to the ground that, they did not comply with paragraph 12 of the Court’s practice direction.
He said, “We therefore pray the Court to strike out the Appeal”.
Since there was no objection raised by the Respondents in the Appeal, to the application of withdrawal, the Court struck out the Appeal.
