EFCC Vs Sen. Danjuma Goje: Court adjourns to 16th January, 2019, for adoption of written addresses

A Federal High Court sitting in Jos Division has adjourned to 16th January, 2019, for adoption of final written addresses between the Economic and financial Crime Commission (EFCC) and Senator Danjuma Goje, a former governor of Gombe state and 3 orders, over alleged contracts and diversion of public funds .

Hon. Justice Musa Kurya, the presiding Judge, while adjourning the matter said the exercise was to enable the Defendant’s Counsel, reply to the application earlier filed by EFCC’s Prosecution Counsel, Wahab Shittu (Esq), on points of Law.

The Defendant Counsel, Chris Uche (SAN), before the adjournment, had moved an application seeking for extension of time to respond to a motion filed by the EFCC on point of Law. He had also argued that the EFCC’s Motion was filed out of time.

Uche (SAN) partly said, “We have before this Honourable Court this morning a motion for extension of time to regularize the Court process. With the kind permission of the Court, I beg to move the application so that we can make progress”.

According to the Counsel, the application was filed on 13th September, 2018 and filed on the 14th September, 2018, praying the Court for another extension of time for the Defendant to file their response. The application Uche (SAN), told the court is accompanied by a 4 paragraph Affidavit and a written address.

Although not objecting to the application, Counsel to EFCC, Wahab (Esq) told the Court that he has replied the Defendant. That the reply is dated 23rd Nov, 2018 and was filed 29th November, 2018.

He said, “We serve the copies on the Defendant this morning in order to assist the Court file the electronic copy”.

However, the Defendant’s Counsel, Uche (SAN), objected to the electronic copies, stating that they have to supply the Defendant with the necessary documents.

While reacting on the issues, which led to the adjournment, the prosecution Counsel, told journalists at the Court premises that after closing the case with 25 witnesses, 45 days ago the Defendant has not filed any single response.

Counsel to Sen. Danjuma Goje on his part, disclosed that they are only witch hunting his clients, as he accused EFCC of being political dogs against the opposition. He said for 7 years, EFCC had been prosecuting his clients and only to start complaining when the accused are just opening defense.
